The cleaver has fallen, Lidl has just been rejected by the justice for the plagiarism of the most famous Gin in Scotland. Hendrick’s stronger than the great distibution?
Indeed, the hard discount brand has ordered the cessation of the marketing of its gin bottles because of their packaging that resembles that of the Hendrick’s brand.
After several months of litigation, the Scottish court ruled that the supermarket chain had not complied with trademark legislation.
Among the problematic points highlighted in the face of justice, the lawyers have therefore pointed to the resemblance of visual aspect between the two bottles, which would be intended to deceive the consumer.
But not only: with the success of the German brand throughout Europe, they also fear that Hendrick’s sales will suffer from such competition at a discounted price.
Hendrick’s has also requested that these competing bottles be removed from across the UK. Case to follow…
This could give ideas to another famous brand, which has also seen a bottle appear on the shelves of Lidl Germany that looks suspiciously like the well-known Gin of the Black Forest… Monkey 47 !
